This Privacy Policy explains how LeadPhoenix LLC ("LeadPhoenix," "we," "us," or "our") collects, uses, and discloses information about you when you use LeadPhoenix OS — a software platform that helps insurance agents manage and communicate with their leads and customers, including via SMS and email — together with our related websites, mobile applications, and other services (collectively, the "Services").
1. Information We Collect
- Account & contact information: name, email address, phone number, mailing address, billing information, and other information you provide when you create an account, contact us, or purchase a subscription.
- Customer lead data you upload: when you use LeadPhoenix OS, you may upload information about your own leads and customers, including their names, phone numbers, email addresses, demographic details, and prior communication history. This data remains yours; we process it on your behalf to provide the Services.
- Communication data: phone numbers, SMS and MMS message content and metadata (delivery status, timestamps, opt-in / opt-out events), email content and metadata, and call logs generated by your use of the Services. We log this data to provide the Services, support deliverability, and assist with troubleshooting and compliance.
- Usage information: IP address, browser type, device information, pages visited, feature interactions, and similar log data.
- Location information: with your consent, approximate location derived from IP address or device GPS.
2. How We Use Your Information
- To provide, operate, secure, and improve the Services.
- To transmit SMS, MMS, and email messages on your behalf to recipients you specify, and to log delivery status for those messages.
- To communicate with you about your account, billing, support requests, product updates, and security notices.
- To analyze usage patterns and improve product performance, reliability, and security.
- To comply with legal and regulatory obligations and to enforce our Terms of Service.
3. SMS and Messaging Data
LeadPhoenix OS transmits SMS, MMS, and email messages on behalf of our customers. To deliver these messages, we share necessary data with third-party providers, including telephony aggregators (such as LeadConnector / LC Phone), mobile carriers, and email infrastructure providers. These providers process message content and metadata only to deliver messages and to meet regulatory requirements.
You, the customer, are responsible for obtaining the legal consent required to message any phone numbers or email addresses you upload into the Services. See our Terms of Service for details.
No mobile information collected by LeadPhoenix is shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors that provide support services (such as customer-support tooling) is permitted. Text-messaging originator opt-in data and consent will not be shared with any third parties.
4. Cookies and Analytics
We use cookies and similar technologies to operate the Services and to analyze usage. You can control cookies through your browser settings, though some features of the Services may not function correctly if cookies are disabled.
5. Data Security
We take reasonable technical and organizational measures to protect information from unauthorized access, use, alteration, and disclosure. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.
6. Your Choices
- Access and correction: you may request access to the personal information we hold about you and request corrections.
- Marketing opt-out: you may opt out of marketing communications from us by following the unsubscribe instructions in such messages.
- Account closure: you may close your account at any time. Some data may be retained as required by law or for legitimate business purposes (billing records, fraud prevention, audit logs, etc.).
7. Children's Privacy
The Services are not intended for children under the age of 16. We do not knowingly collect personal information from children under 16. If we learn that we have collected such information, we will delete it.
8. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website with a new effective date.
